Plenty of people in community who deserve nomination

IF YOU know someone who deserves recognition for the good deeds they do, you need to do a good deed first and nominate them.

There's only about a week to go before Mackay Regional Council Australia Day award nominations close and in some categories the lack of entries is a real concern, according to corporate communications manager Ken Furdek.

"We often see a noticeable increase in nominations in the first week of the new year, and we're hoping that will be the case this year, but submissions for the two new categories are really concerning," Mr Furdek said.

"These are the South Sea Islander Achievement Award, which is a one-off for 2013 because it marks their 150 years of settlement, and the Environmental Achievement Award.

"The other area where we notoriously struggle for nominations is Sarina, and this happens every year.

"There are a lot of people in Sarina who do a lot of good things, and we need these worthy people to be nominated." Mr Furdek said people may have misconceptions about the type of people who could be nominated for an award.

"This is for people who do something for their community, people who do good deeds, and that can be mowing a neighbour's lawn every week.

"They don't need to be outstanding achievers," Mr Furdek said.

The 2012 Young Citizen of the Year, Cale Hutchins, also is encouraging people to put in nominations.

"Come hell or high water the people of Mackay always chip in," Mr Hutchins said.

"We have some real community heroes and fantastic volunteers out there that deserve recognition, even though they don't do these things for rewards."

Western Connecticut tops College of Staten Island in women's hoops, 77-56

DANBURY, Conn. ? Western Connecticut State freshman forward Sha?Quira Palmer had 15 points and 14 rebounds as the Colonials defeated the College of Staten Island 77-56 Saturday in women?s basketball.

Western (7-3) used a 52-29 rebounding edge to overwhelm visiting CSI (6-5), taking a 40-27 halftime lead fueled by a 14-0 run to break a 9-9 deadlock.

Carly Murphy scored a game-high 18 points and Jackie Zilnicki added 13 in a winning cause, while freshman guard Lisa Galasso topped the Dolphins with 14 points followed by Nikki Fabozzi with 13 and Megan Myhre with 12.

In 2013, small-business owners will contend with many of the same issues that made it hard to run their companies over the last 12 months.

They?re also heading into the new year with a lot of uncertainty. It?s unlikely that negotiations in Congress will resolve all of lawmakers? disagreements over tax and budget issues that affect small businesses. And there are still many questions about the implications of the health care law for small companies.

That points to continued caution ? and perhaps slow hiring ? among the nation?s small companies.

"Uncertainty is the bane of every small business," says Scott Shane, a professor of entrepreneurship at Case Western Reserve University?s Weatherhead School of Management in Cleveland. "Their only rational response is to pull in their horns and slow down."

Small businesses aren?t likely to get much encouragement from the economy. It?s expected to grow by no more than 3 percent in 2013, according to the Federal Reserve. That?s a moderate pace, better than the 1.7 percent that the economy grew during the first three quarters of 2012. But it?s also far from robust.

Here?s a look at some of the issues facing small businesses in the coming year:

Taxes

Lawmakers are still haggling over what?s called the fiscal cliff, the combination of billions of dollars in tax increases and budget cuts. Even if Congress reaches an agreement, small-business owners won?t have the certainty they need, according to Todd McCracken, president of the National Small Business Association, a group that lobbies on behalf of small companies.

"It almost surely won?t be comprehensive enough that we won?t be revisiting it next year," McCracken says. He?s concerned that there?ll be another fiscal cliff in six months ? which would mean more negotiations and more uncertainty.

Many small-business owners are worried about their personal tax rates. Sole proprietors, partners and owners of what are called S corporations, all report the income from their businesses on their individual Form 1040 returns. That means their companies are in effect taxed at personal rates, which can be higher than corporate rates.

One of the most important tax provisions for small businesses, the Section 179 deduction, will shrink to $25,000 next year from $125,000 in 2012. The deduction, which applies to equipment purchases, was $500,000 in 2011. Congress can increase the deduction at any time, even after 2013 has begun. But for the time being, business owners can?t count on getting a big break.

"It?s a huge change for companies planning on making investments," McCracken says.

It?s not known if Congress will extend the 2 percentage point payroll tax cut that workers have had for two years. If it doesn?t, consumers will have less money in their paychecks to spend, and that is likely to affect retailers and any other small businesses that sell directly to the public.

Health care

Health care has been another source of uncertainty for small-business owners. The new year will bring some, but probably not all, of the answers to questions about how the new health care law will affect them. Many will have to devote some time to understanding the law ? or hire someone to help them do it.

India gang-rape victim dies in hospital

The 23-year-old who was gang-raped in New Delhi and thrown from a bus has died from her injuries in Singapore, where she was being treated. NBC's Natalie Morales reports.

SINGAPORE ? A 23-year-old Indian woman who was gang-raped and severely beaten on a bus in New Delhi died Saturday at a Singapore hospital.

The woman's horrific ordeal galvanized Indians to demand greater protections against widespread sexual violence, and her death was expected to intensify public demands for action by the Indian government.

The victim who has not been identified,?"passed away peacefully" with her family and officials of the Indian embassy by her side," said Kelvin Loh, the chief executive of Mount Elizabeth Hospital, where she had been treated since Thursday. "The Mount Elizabeth Hospital team of doctors, nurses and staff join her family in mourning her loss," he said in a statement.


The woman and a male friend were traveling in a public bus after watching a film on the evening of Dec. 16 when they were attacked by six men who took turns raping her. They also beat the couple and inserted an iron rod into her body resulting in severe organ damage. Both of them were then stripped and thrown off the bus, according to police.

The woman was airlifted to Singapore on Dec. 26 for specialist treatment, but she had remained in extremely critical condition, Loh said.

The victim had already undergone three abdominal operations before arriving in Singapore, where her condition on Thursday was described as "extremely critical."

"Despite all efforts by a team of eight specialists in Mount Elizabeth Hospital to keep her stable, her condition continued to deteriorate over these two days," said Loh on Saturday. "She had suffered from severe organ failure following serious injuries to her body and brain. She was courageous in fighting for her life for so long against the odds but the trauma to her body was too severe for her to overcome."

The attack triggered nationwide protest?over the lack of safety for women, culminating last weekend in pitched battles between police and protesters in the heart of the capital.

New Delhi has the highest number of sex crimes among India's major cities, with a rape reported on average every 18 hours, according to police figures. Government data show the number of reported rape cases in the country rose by nearly 17 percent between 2007 and 2011.

Prime Minister Manmohan Singh's government seemed at first caught off guard by the reaction to the attack, which sparked a blame game between politicians and the police.

On Saturday he said that he was aware of the emotions the attack has stirred and that it was up to all Indians to ensure that the young woman's death will not have been in vain.

"These are perfectly understandable reactions from a young India and an India that genuinely desires change," Singh said in a statement. "It would be a true homage to her memory if we are able to channel these emotions and energies into a constructive course of action."

He said the government was examining the penalties for crimes such as rape "to enhance the safety and security of women."

Indian television channels said security had been tightened in New Delhi on Saturday in anticipation of more protests following the woman's death.

Stahl arrested for investigation of lewd conduct

LOS ANGELES (AP) ? Los Angeles police say actor Nick Stahl has been arrested for investigation of lewd conduct.

The 33-year-old "Terminator 3" star was arrested about 8 p.m. Thursday on Hollywood Boulevard. He was booked on a misdemeanor count of lewd conduct and released from custody.

The Los Angeles Times reports (http://lat.ms/YU6uBO) that Stahl was arrested at an adult movie shop during a routine undercover police operation.

In May, Stahl had been reported missing by his wife, but he later turned up.

Stahl was a child star who performed in the 1993 film "The Man Without a Face." He also has appeared in the 2003-2005 HBO series "Carnivale'" and starred in "Mirrors 2" in 2010. An email seeking comment from his publicist was not immediately returned Friday.

Cellular fuel gauge may hold the key to restricting cancer growth

Dec. 27, 2012 ? Researchers at McGill University have discovered that a key regulator of energy metabolism in cancer cells known as the AMP-activated protein kinase (AMPK) may play a crucial role in restricting cancer cell growth. AMPK acts as a "fuel gauge" in cells; AMPK is turned on when it senses changes in energy levels, and helps to change metabolism when energy levels are low, such as during exercise or when fasting. The researchers found that AMPK also regulates cancer cell metabolism and can restrict cancer cell growth.

The discovery was made by Russell (Rusty) Jones, an assistant professor at McGill's Goodman Cancer Research Centre and the Department of Physiology, Faculty of Medicine. Jones along with his team is the first to show that AMPK can act as a tumour suppressor in animals. The research will be published December 27 in the journal Cell Metabolism.

"Cancer is a disease in which cells lose their normal restraints on growth and start to divide uncontrollably. But, in order for cells to grow quickly they need enough energy to complete the task," Jones explained. "AMPK acts like the fuel gauge in your car -- it lets the body know when energy levels are low, and stops cell growth until there is enough gas in the tank. We wanted to see if this fuel gauge could affect the development and progression of cancer. We found that mice lacking AMPK developed tumours faster, suggesting that AMPK is important for keeping tumour development in check, at least for some types of cancer." For this study, Jones' team focused specifically on a type of blood cancer known as lymphoma. They discovered that the protein Myc, which is activated in more than half of all cancers, could promote lymphoma more rapidly when mice were deficient for AMPK.

One of the ways cancer cells support their enhanced rate of growth is by changing their metabolism, or how they generate energy. Cancer cells are different from normal cells in our body because they preferentially use sugar to fuel their growth. Jones discovered that AMPK plays a specific role in restricting cancer cells' ability to use sugar to fuel their growth. "For cancer cells with low AMPK levels, their metabolism goes into overdrive," explained Prof. Jones. "They use sugar more efficiently, allowing them to grow faster. These results suggest that turning on AMPK in cancer cells may be one way that we can restrict cancer growth."

Jones' breakthrough builds on his previous discovery that the widely prescribed medication metformin, a common diabetes drug, can restrict tumour cell growth. The results bring promise that common therapeutics that turn on AMPK and alter cellular metabolism, such as metformin, may become novel tools for cancer therapy. Jones and his colleagues at McGill are currently exploring clinical applications based on this research.

Seattle Seahawks cornerback Richard Sherman continues to wait for the ruling on his appeal of a four-game suspension for a violation of the league?s performance-enhancing drug policy.

It?s been over a month since it was first reported that Sherman and teammate Brandon Browner were facing suspensions for testing positive for a banned substance. Browner dropped his appeal and will be eligible to return for the playoffs, but Sherman has continued to fight his positive test.

Even if the decision (expected on Thursday) goes against Sherman and he is suspended by the league, he plans on continuing his fight. Sherman said Wednesday that he will continue to explore other legal options and could ultimately end up suing the league.

?I can?t get back playing regardless. I can just sue the league, and that?s probably what I?m going to do if they suspend me,?? Sherman said.

Adam Schefter of ESPN has reported that Sherman?s appeal was based around a supposed break in procedure in the collection process. The cup used to collect Sherman?s urine sample was apparently broken, requiring a second cup to be placed underneath to prevent leakage. The seal on the second cup was also broken.

Sherman tweeted on Christmas some more thoughts on the basis of his appeal to the league.

?Hoping we play in a just League @nfl. Not a league that allows a tester to mix urine samples. A tester with a history of errors. Has has had to have 6 other tests thrown out and he has only been testing 6months,? he tweeted.

Sherman was also asked Wednesday about his thoughts on how the appeal has played out to this point.

?It?s been pretty standard other than the league telling you they can break rules,? Sherman said. ?They don?t care if you took it or you didn?t take it, if the sample is tainted or it isn?t tainted, they said it doesn?t matter. The collective bargaining, there?s policies, there?s rules in the policies that they said should not apply to them and they wrote them. That?s just how the league does things.?

With the track record of PED suspensions being overturned, it appears likely that Sherman will be suspended on Thursday. While he won?t have a recourse to get the four games back, Sherman appears adamant in continuing this fight in whatever fashion he has to.

If he?s suspended, Seattle could get Sherman back in time for the Super Bowl if they play in the first round of the playoffs. If they manage to backdoor into the No. 2 seed and a first-round bye with San Francisco and Green Bay losses this weekend, Sherman?s season would be over.

Survey finds increase in e-reading, drop in paper

The tastes of the reading public are turning digital.

A Pew Internet Research Center survey released Thursday found that the percentage of Americans aged 16 and older who read an e-book grew from 16 percent in 2011 to 23 percent this year. Readers of traditional books dropped from 72 percent to 67 percent. Overall, those reading books of any kind dropped from 78 percent to 75 percent, a shift Pew called statistically insignificant.

Those owning an e-book device or tablet jumped from 18 percent to 33 percent, with much of that increase coming from last year's holiday season, when millions received Kindles, Nooks and other e-readers as gifts.

Awareness that libraries offer digital texts grew from 24 percent to 31 percent.

The telephone survey of 2,252 people aged 16 and older was conducted from Oct. 15 to Nov. 10. It has a sampling error margin of plus or minus 2.3 percentage points.

New insight into cell development and cancer

Dec. 27, 2012 ? Long-standing research efforts have been focused on understanding how stem cells, cells capable of transforming into any type of cell in the body, are capable of being programmed down a defined path to contribute to the development of a specific organ like a heart, lung, or kidney. Research from the University of North Carolina at Chapel Hill School of Medicine has shed new light on how epigenetic signals may function together to determine the ultimate fate of a stem cell.

The study, published December 27, 2012 by the journal Molecular Cell, implicates a unique class of proteins called polycomb-like proteins, or PCL's, as bridging molecules between the "on" and "off" state of a gene. While all of these specialized types of cells share the same genetic information encoded in our DNA, it is becoming increasingly clear that information outside the genome, referred to as epigenetics, plays a central role in orchestrating the reprogramming of a stem cell down a defined path.

Although it is understood that epigenetics is responsible for turning genes "on" and "off" at defined times during cellular development, the precise mechanisms controlling this delicate process are less well understood.

"This finding has important implications for both stem cell biology and cancer development, as the same regulatory circuits controlled by PCL's in stem cells are often misregulated in tumors," said Dr. Greg Wang, senior author of the study and Assistant Professor of Biochemistry and Biophysics in the UNC School of Medicine and a member of UNC Lineberger Comprehensive Cancer Center.

The study, led by postdoctoral research fellows Drs. Ling Cai and Rui Lu in the Wang lab, and Dr. Scott Rothbart, a Lineberger postdoctoral fellow in the lab of Dr. Brian Strahl, Associate Professor of Biochemistry and Biophysics in the UNC School of Medicine and a member of UNC Lineberger Comprehensive Cancer Center, identified that PCL's interact with an epigenetic signal associated with genes that are turned on to recruit a group of proteins called the PRC2 complex which then turn genes off.

"In stem cells, the PRC2 complex turns genes off that would otherwise promote reprogramming into specialized cells of organs like the heart or lungs," said Wang.

In addition to its fundamental role in cellular development, elevated levels of PRC2 have been found in cancers of the prostate, breast, lung, and blood, and pharmaceutical companies are already developing drugs to target PRC2. Wang and colleagues determined that the same mechanisms controlling PRC2 function in stem cells also applies in human cancers.

"The identification of a specific PCL in controlling PRC2 in cancer cells suggests we may be able to develop drugs targeting this PCL to regulate PRC2 function in a more controlled manner that may maintain PRC2 function in stem cells while inhibiting it in the tumor," said Wang.

This research was funded by the National Institutes of Health grants (GM085394 and GM068088), the Department of Defense, the V Foundation for Cancer Research, and the University Cancer Research Fund, and was performed in collaboration with scientists at the University of California at Riverside, Rockefeller University, Memorial Sloan-Kettering Cancer Center, and the Albert Einstein College of Medicine. Study co-authors from UNC also included Bowen Xu, a student in the Wang Lab, and Ashutosh Tripathy, a Research Professor in the Department of Biochemistry and Biophysics.

HOUSTON (AP) ? Former President George H.W. Bush is being treated in the intensive care unit at a Houston hospital after suffering "a series of setbacks," including a stubborn fever, his spokesman said.

In a brief email Wednesday, Jim McGrath, Bush's spokesman in Houston, said the 88-year-old former leader had been admitted Sunday to the ICU at Methodist Hospital. McGrath said Bush, the oldest living former U.S. president, was alert and talking to medical staff.

He said doctors are cautiously optimistic about Bush's treatment and that the former president "remains in guarded condition." He said Bush was surrounded by family.

Early Thursday, McGrath told The Associated Press he had no new information on Bush's condition and that he would release another statement "when events warrant it."

Bush has been hospitalized since Nov. 23, when he was admitted for a lingering cough related to bronchitis after having been in and out of the hospital for complications related to the illness.

A fever that kept Bush in the hospital over Christmas had gotten worse and doctors had put him on a liquids-only diet Wednesday following "a series of setbacks."

"It's an elevated fever, so it's actually gone up in the last day or two," McGrath said. "It's a stubborn fever that won't go away."

But he said the cough that initially brought Bush to the hospital had improved.

Bush was visited on Christmas by his wife, Barbara, his son, Neil, and Neil's wife, Maria, and a grandson, McGrath said. Bush's daughter, Dorothy, arrived Wednesday in Houston from Bethesda, Md. The 41st president has also been visited by his sons, George W. Bush, the 43rd president, and Jeb Bush, the former governor of Florida.

He has also been visited by former Secretary of State James A. Baker III, a longtime confidant.

Bush and his wife live in Houston during the winter and spend their summers at a home in Kennebunkport, Maine.

The former president was a naval aviator in World War II ? at one point the youngest in the Navy ? and was shot down over the Pacific. He's skydived on at least three of his birthdays since leaving the White House in 1992.

He suffers from a form of Parkinson's disease and in recent years has used a wheelchair to get around.

(AP) ? Defying a storm of domestic and international criticism, Russia moved toward finalizing a ban on Americans adopting Russian children, as Parliament's upper house voted unanimously Wednesday in favor of a measure that President Vladimir Putin has indicated he will sign into law.

The bill is widely seen as the Kremlin's retaliation against an American law that calls for sanctions against Russians deemed to be human rights violators. It comes as Putin takes an increasingly confrontational attitude toward the West, brushing aside concerns about a crackdown on dissent and democratic freedoms.

Dozens of Russian children close to being adopted by American families now will almost certainly be blocked from leaving the country. The law also cuts off the main international adoption route for Russian children stuck in often dismal orphanages: More than 60,000 Russian youngsters have been adopted in the United States in the past 20 years. There are about 740,000 children without parental care in Russia, according to UNICEF.

All 143 members of the Federation Council present voted to support the bill, which has sparked criticism from both the United States and Russian officials, activists and artists, who say it victimizes children by depriving them of the chance to escape the squalor of orphanage life. The vote comes days after Parliament's lower house overwhelmingly approved the ban.

Seven people with posters protesting the bill were detained outside the Council before Wednesday's vote. "Children get frozen in the Cold War," one poster read. Some 60 people rallied in St. Petersburg, Russia's second largest city.

The bill is part of larger legislation by Putin-allied lawmakers retaliating against a recently signed U.S. law that calls for sanctions against Russians deemed to be human rights violators. Although Putin has not explicitly committed to signing the bill, he strongly defended it in a press conference last week as "a sufficient response" to the new U.S. law.

Originally Russia's lawmakers cobbled together a more or less a tit-for-tat response to the U.S. law, providing for travel sanctions and the seizure of financial assets in Russia of Americans determined to have violated the rights of Russians.

But it was expanded to include the adoption measure and call for a ban on any organizations that are engaged in political activities if they receive funding from U.S. citizens or are determined to be a threat to Russia's interests.

Russian children's rights ombudsman Pavel Astakhov told the Interfax news agency that 46 children who were on the verge of being adopted by Americans would stay in Russia if the bill is approved ? despite court rulings in some of these cases authorizing the adoptions.

The ombudsman supported the bill, saying that foreign adoptions discourage Russians from adopting children. "A foreigner who has paid for an adoption always gets a priority compared to potential Russian adoptive parents," Astakhov was quoted as saying. "A great country like Russia cannot sell its children."

Russian law allows foreigners to adopt only if a Russian family has not expressed interest in a child being considered for adoption.

Some top government officials, including the foreign minister, have spoken flatly against the adoption law, arguing that the measure would be in violation of Russia's constitution and international obligations.

But Senator Mikhail Margelov, chairman of the Council's foreign affairs committee, referred to the bill as "a natural and a long overdue response" to the U.S. legislation. "Children must be placed in Russian families, and this is a cornerstone issue for us," he said.

Margelov said that a bilateral Russian-U.S. agreement binds Russia to give notice of a halt to adoptions 12 months in advance. Putin spokesman Dmitry Peskov told Russian news agencies that the president would consider the bill within the next two weeks.

The measure has become one of the most debated topics in Russia.

By Tuesday, more than 100,000 Russians had signed an online petition urging the Kremlin to scrap the bill.

Over the weekend, dozens of Muscovites placed toys and lit candles in front of the Duma, Russia's lower house of parliament after it approved the bill on Friday, but security guards promptly removed them. Opposition groups said they will rally against the bill on Jan. 13, and several popular artists publicly voiced their concern about the legislation.

While receiving a state award from Putin on Wednesday, film actor Konstantin Khabensky wore a badge saying "Children Are Beyond Politics." Veteran rock musician Andrey Makarevich called on Putin Monday to stop "killing children."

During a marathon Putin press conference Thursday, eight of the 60 questions the president answered focused on the bill. Responding angrily, Putin claimed that Americans routinely mistreat children from Russia.

The bill is named in honor of Dima Yakovlev, a Russian toddler who was adopted by Americans and then died in 2008 after his father left him in a car in broiling heat for hours. The father was found not guilty of involuntary manslaughter.

Russian lawmakers argue that by banning adoptions to the U.S. they would be protecting children and encouraging adoptions inside Russia.

In a measure of the virulent anti-U.S. sentiment that has gripped parts of Russian society, a few lawmakers went even further, claiming that some Russian children were adopted by Americans only to be used for organ transplants and become sex toys or cannon fodder for the U.S. Army.

People keep touting the idea of mining metals from asteroids and using it to build spacecraft outside of the earth's gravity well, but do we actually know how to do that?

The mining side of things seems relatively straight-forward (not easy, but you wouldn't need anything radically new), but smelting and refining significant amounts of ore in low gravity could be rather difficult. As far as I understand, a traditional iron smelting plant uses gravity to help with the purification, allowing the slag to float to the surface, before tapping the good quality iron from the bottom of the blast furnace.

It seems like purifying and working ore in space would require entirely new ways of working with the raw materials. Perhaps using some kind of high temperature centrifuge to spin and separate the material.

I'm not saying it's not possible, but it doesn't seem quite as easy as some of the more excitable science-fictiony plans for space exploration treat it. Many of these plans feature major problems to solve that get glossed over as minor technicalities.

Your recourse depends on your airline and what they?ve put in your contract for the ticket. Many airlines say that they will attempt to rebook you on a different flight, even on another airline, but they don?t guaranty it and while some will put you up in a hotel, most don?t pay for your extra stay because of flight cancellation so you?ll be left to find your own hotel room or sleep on the floor of the airport and you really will look and feel like a zombie when you finally arrive.

Hepatitis C tests continue after NH tech's arrest

CONCORD, N.H. (AP) ? Hospitals across the country recommended hepatitis C testing for about 7,900 patients last summer after a traveling medical worker was accused of stealing drugs and infecting patients with tainted syringes in New Hampshire. But five months later, nearly half of those who were possibly exposed to the liver-destroying disease in other states have yet to be tested.

Described by prosecutors as a "serial infector," David Kwiatkowski is accused of stealing syringes of the powerful painkiller fentanyl from the cardiac catheterization lab at New Hampshire's Exeter Hospital and replacing them with saline-filled syringes tainted with his own blood. In jail since his arrest in July, he pleaded not guilty to 14 federal drug charges earlier this month and is expected to go to trial next fall.

Before April 2001, when he was hired in New Hampshire, Kwiatkowski worked as a traveling cardiac technologist in 18 hospitals in seven states, moving from job to job ? despite being fired twice over allegations of drug use and theft.

Thirty-two people in New Hampshire have been diagnosed with the same strain of hepatitis C that Kwiatkowski carries, along with six in Kansas, five in Maryland and one in Pennsylvania. At least 3,700 people outside New Hampshire have yet to be tested, hospitals and public health officials told The Associated Press.

For example, in Michigan, where Kwiatkowski grew up and started his career, about 2,300 patients at five hospitals were notified that they may have been exposed to hepatitis C by Kwiatkowski. As of early December, only about 500 had gone in for testing, none of whom were diagnosed with a strain linked to the New Hampshire outbreak, according to the Michigan Department of Community Health.

In Pennsylvania, 2,280 patients at the University of Pittsburgh Medical Center Presbyterian were notified that they should get tested, but only 840 have, one of whom was diagnosed with a matching strain of hepatitis C.

Kwiatkowski was fired a few weeks into his temporary job at UPMC in 2008 after a co-worker accused him of swiping a fentanyl syringe from an operating room and sticking it down his pants. Citing a lack of evidence, hospital authorities didn't call police, and neither the hospital nor the medical staffing agency that placed him in the job informed the national accreditation organization for radiological technicians. Within days, Kwiatkowski was starting a new job at the Baltimore VA Medical Center, where one patient also has since been diagnosed with hepatitis C linked to Kwiatkowski.

Though the VA center initially said it had identified 168 patients who may have been exposed, that number was later lowered, and 68 patients ultimately were tested. Two other Maryland hospitals where Kwiatkowski worked also have completed their testing, with no diagnosed cases of hepatitis C matching Kwiatkowski. But at the fourth, The Johns Hopkins Hospital in Baltimore, four patients have been diagnosed with the strain of disease linked to Kwiatkowski.

About 500 of the 1,567 patients notified by Johns Hopkins have yet to be tested, according to hospital spokeswoman Kim Hoppe. Kwiatkowski had been referred by a staffing agency that assured Johns Hopkins that it had followed a vigorous vetting process, Hoppe said. He worked there for two 13-week stints, from July 2009 to January 2010.

Saint Francis Hospital in Poughkeepsie, N.Y., where Kwiatkowski worked in late 2007 and early 2008, notified and tested 31 patients without finding any linked cases to Kwiatkowski. In Kansas, nearly all of the 416 patients who may have been exposed at Hays Medical Center have been tested and six have been diagnosed with infections linked to the New Hampshire outbreak.

There have been no cases linked to Kwiatkowski in Arizona, where about 300 patients from two hospitals have been asked to get tested and about 280 have done so. Kwiatkowski worked at Maryvale Hospital in Phoenix in 2009 and the Arizona Heart Hospital in 2010. He was fired from the latter job after 10 days after a co-worker found him passed out in a bathroom stall with a stolen fentanyl syringe floating in the toilet.

That incident was reported to police, Kwiatkowski's staffing agency, a state regulatory board and the national accreditation organization, but the accreditation group dropped its inquiry after learning police hadn't filed charges.

Days later, Kwiatkowski landed a new job filling in for striking technicians at Temple University Hospital in Philadelphia. That hospital has recommended testing for 312 patients but won't say how many have followed through or have been diagnosed with hepatitis C. A hospital spokesman referred questions to the city health department, which did not return calls.

Testing also is still under way in the last place Kwiatkowski worked before heading to New Hampshire ? Houston Medical Center in Warner Robins, Ga. According to the hospital, fewer than 100 people have yet to be tested, and there haven't been any cases yet linked to Kwiatkowski.

In New Hampshire, where about 3,300 patients were tested, Kwiatkowski is charged with seven counts of illegally obtaining drugs and seven counts of tampering with a consumer product, though prosecutors have said further charges are possible. Although New Hampshire cannot charge him for possible violations in other states, it can use evidence gathered in those jurisdictions in its trial, U.S. Attorney John Kacavas said. Other states are waiting to see the outcome of New Hampshire's case before deciding whether to file charges, he said.

"We continue to reach out to other states affected by this matter," Kacavas said this week. "Other health organizations and departments continue to do their work in their states, but nothing has changed in the sense that our prosecution will go forward. At this point, we are the only prosecution in the country, and we'll see how it rolls out."

Fiscal Cliff Leaves John Boehner A Wounded Speaker

WASHINGTON -- John Boehner is a bloodied House speaker following the startling setback that his own fractious Republican troops dealt him in their "fiscal cliff" struggle against President Barack Obama.

There's plenty of internal grumbling about the Ohio Republican, especially among conservatives, and lots of buzzing about whether his leadership post is in jeopardy. But it's uncertain whether any other House Republican has the broad appeal to seize the job from Boehner or whether his embarrassing inability to pass his own bill preventing tax increases on everyone but millionaires is enough to topple him.

"No one will be challenging John Boehner as speaker," predicted John Feehery, a consultant and former aide to House GOP leaders. "No one else can right now do the job of bringing everyone together" and unifying House Republicans.

The morning after he yanked the tax-cutting bill from the House floor to prevent certain defeat, Boehner told reporters he wasn't worried about losing his job when the new Congress convenes Jan. 3.

"They weren't taking that out on me," he said Friday of rank-and-file GOP lawmakers, who despite pleading from Boehner and his lieutenants were shy of providing the 217 votes needed for passage. "They were dealing with the perception that somebody might accuse them of raising taxes."

That "somebody" was a number of outside conservative groups such as the Club for Growth and Heritage Action for America, which openly pressured lawmakers to reject Boehner's bill. Such organizations often oppose GOP lawmakers they consider too moderate and have been headaches for Boehner in the past.

This time, his retreat on the tax measure was an unmistakable blow to the clout of the 22-year House veteran known for an amiable style, a willingness to make deals and a perpetual tan.

Congressional leaders amass power partly by their ability to command votes, especially in showdowns. His failure to do so Thursday stands to weaken his muscle with Obama and among House Republicans.

"It's very hard for him to negotiate now," said Sarah Binder, a George Washington University political scientist, adding that it's premature to judge if Boehner's hold on the speakership is in peril. "No one can trust him because it's very hard for him to produce votes."

She said the loss weakens his ability to summon support in the future because "you know the last time he came to you like this, others didn't step in line."

Boehner, 63, faces unvarnished hostility from some conservatives.

"We clearly can't have a speaker operate well outside" what Republicans want to do, said freshman Rep. Tim Huelskamp, R-Kan.

Huelskamp is one of four GOP lawmakers who lost prized committee assignments following previous clashes with party leaders. That punishment was an anomaly for Boehner, who is known more for friendly persuasion than arm-twisting.

He said Boehner's job would depend on whether the speaker is "willing to sit and listen to Republicans first, or march off" and negotiate with Obama.

Conservative Rep. Steve King, R-Iowa, said one of the tea party's lasting impacts would be if Boehner struggled to retain his speakership due to the fight over the fiscal cliff, which is the combination of deep tax increases and spending cuts that start in early January without a bipartisan deal to avert them.

"If there's a major defeat delivered here, it could make it tough on him," King said. "He's in a tough spot."

Defenders say Boehner has been dealt a difficult hand. They say that in nearly two years as speaker, he's been field general over an unruly GOP majority confronting a Democratic president and Senate, steering them to the best outcomes possible.

House Republicans won some spending cuts early on. But they were faulted by the public for nearly causing a federal default in a 2011 fight over extending the government's debt limit, and lost a later battle over renewing a payroll tax cut.

This year, they've suffered in the polls for resisting the extension of wide-ranging tax cuts unless the wealthiest earners were included, which Obama opposes. They saw their House majority whittled by eight seats in last month's elections.

"He's doing a good job in a tough situation," said Sen. Rob Portman, R-Ohio, a Boehner friend. He said the speaker's challenges include "independent individuals" among House Republicans and the increased willingness of outside conservatives to pressure GOP leaders, not defer to them.

Portman said he didn't know if Boehner's tax bill debacle would weaken him.

"It proved to the president what he's been saying, that there are limits to how far he can go" in making concessions in fiscal cliff bargaining, said Portman. "But a win would have improved chances for an agreement" by demonstrating that Boehner could deliver votes.

"His own Republican team let him down and that always hurts a leader," said veteran Rep. Jack Kingston, R-Ga.

Republicans watching closely for overt or subtle moves by would-be challengers to Boehner said Friday they'd detected none, though such moves are notoriously secretive.

The entire House elects its speaker by majority vote on the first day of the new session. Because the 201 Democrats will probably all back Rep. Nancy Pelosi, D-Calif., for the job, a GOP effort to depose Boehner would have to occur internally and before the full House votes so Republicans ? with 234 seats ? elect one of their own as speaker.

Possible candidates to replace Boehner, according to GOP lawmakers and aides, include Majority Leader Eric Cantor of Virginia, third-ranking Rep. Kevin McCarthy of California, GOP vice presidential nominee Paul Ryan, R-Wis., and Rep. Tom Price of Georgia.

Cantor was at Boehner's side Friday as both men met with reporters. Cantor, McCarthy and Ryan lobbied colleagues for Boehner's tax-cut bill, giving Republicans angry over the measure little reason to turn to them as alternatives.

"I recognize why these questions are getting asked," conservative freshman Rep. Mick Mulvaney, R-S.C., said about whether Boehner was in trouble. "I see nothing giving any evidence to that end. It was not a vote of no confidence on John Boehner. It was a legislative defeat, not a personal defeat."
