Turkish Airlines Investigated for Tax Fraud in Israel

Turkish Airlines' Israeli office is currently being investigated for alleged tax evasion amounting to over 1.5 million shekels ($418,000), the Justice Ministry said Monday, according to the Israel Hayom daily.

The newspaper quoted a statement published by the Ministry which said that the Tel Aviv District Prosecution's Taxes and Economics Department is considering pressing criminal charges against the company as well as the head of its local office, Fatih Dogan, for failing to meet Israel's Tax Authority guidelines for foreign companies operating in Israel.

The decision is pending a hearing before the head of the Taxes and Economics Department, attorney Mina Zamir, reported Israel Hayom.

Turkish Airlines in considered one of the world's leading international carriers, and was ranked the seventh-best airline in the world in 2012 and the fastest-growing airline worldwide in 2011.

The company's Israeli office numbers dozens of Turkish employees, whose wages are subjected to both Turkish and Israeli tax laws, noted Israel Hayom.

The Tel Aviv District Prosecution believes that between 2006 and 2010 the airline filed false tax reports in Israel, and that the wages paid to the company's Turkish employees, which were deposited in their bank accounts in Istanbul, were higher than the wages declared in Israel for taxation purposes.

This method allegedly allowed Turkish Airlines' Israeli office to pay its employees "under the table" and avoid deducting taxes that should have been paid to the Israeli authorities.

The investigation into the matter was made public in December 2012, following several months of undercover work by the Tax Authority. Turkish Airlines' office in Tel Aviv was raided by Tax Authority agents, who seized company records and well as several computers, reported Israel Hayom.

Should the hearing conclude that Dogan and Turkish Airlines deliberately perpetrated fraud, they -- alongside the accountants who filed the reports on their behalf -- could be charged with tax evasion, tax fraud, filing false tax reports and falsifying corporate tax records.

A statement by Turkish Airlines, carried by the financial daily Globes, said that the airline "is in compliance with the tax laws and regulation of every country it operates in, including Israel. The company employs the services of Israeli tax advisers and it relied on their advice, which proved wrong. Once we were alerted to the situation, the company made sure to pay the missing taxes. Turkish Airlines will present its case before the [Tel Aviv District] Prosecution and we are sure that our explanation will fall on sympathetic ears."

Israel and Turkey?s relationship has been strained in recent years and the rift between the two countries deepened in May 2010, when Israeli commandos raided a Turkish vessel trying to breach the maritime blockade imposed on Gaza.

Nine Turks died on the Mavi Marmara, which refused Israeli orders to dock at the Ashdod Port. When the ship refused, the commandos boarded it, encountering violence from the members of the IHH organization who were on board and who attacked them with clubs and knives. The soldiers had no choice but to open fire.

Under pressure from U.S. President Barack Obama, Prime Minister Binyamin Netanyahu apologized in March to Turkish Prime Minister Recep Tayyip Erdogan for the deaths of nine Turks in the 2010 flotilla.

Netanyahu, in addition to the apology, agreed to compensate the families of the nine Turks, while Erdogan promised to cancel the legal proceedings his country launched against IDF officials.

Reports have indicated that Israeli and Turkish officials have made progress in talks on compensation for the Marmara incident, but a deal is yet to be finalized.

Last week, however, Turkey?s Deputy Prime Minister Bulent Arinc said that his country will not be satisfied with Israel simply paying compensation to the Marmara victims. The Jewish state, he said, must acknowledge that the money it is paying to the victims is a result of its committing a wrongful act.

A poll released earlier this month found that Israelis are unhappy with the apology to Turkey. 85% of respondents said the chances of their going on vacation to Turkey in the near future are very low.

Only 28% of Israelis believe that relations between Israel and Turkey under Erdogan will improve in the near future, while 42% think relations will stay the same and 30% believe they will deteriorate further.

Most Israelis (71%) believe Israel's apology to Turkey was not justified, while only 29% think it was, the poll found.

Italian government's fate hangs on Berlusconi court ruling

ROME (Reuters) - The fate of Italy's fragile government hangs on a ruling by the supreme court, which meets on Tuesday to decide whether to uphold a tax fraud conviction against former Prime Minister Silvio Berlusconi.

Italy's Cassation Court will rule on the media magnate's final appeal against a jail sentence and 5-year ban from public office handed down by lower courts for the fraudulent purchase of broadcasting rights by his television network Mediaset.

While the political fallout is as uncertain as the decision itself, there is a strong possibility that a guilty verdict would endanger the government of Enrico Letta, an uneasy coalition of his center-left Democratic Party (PD) and Berlusconi's center-right People of Freedom (PDL).

The political uncertainty in the euro zone's third largest economy could cause new jitters throughout the bloc as southern European countries struggle to emerge from grinding recession and debt crises.

The decision by five judges could come on Tuesday or slip into Wednesday or even Thursday, court sources said. The hearing was unexpectedly accelerated to avoid part of the sentence being cancelled by the statute of limitations.

PDL hawks have called for everything from a mass resignation from the government to blocking Italy's motorways if the court rules against the four-times premier, with one of his most devoted supporters, Daniela Santanche, saying it would be "an assault on democracy."

Berlusconi and his supporters accuse leftist magistrates of persecuting him for 20 years to try to keep him out of power.

But a greater risk to the government could come from Letta's faction-ridden PD, many of whose members are already deeply unhappy with being in a coalition with their old enemy and may refuse to continue if he is found guilty.

However, both President Giorgio Napolitano, who dragged the parties into a coalition in April after a two-month crisis that followed inconclusive elections, and Letta himself are adamant that Italy cannot afford more instability as it struggles to climb out of its worst postwar recession.

"I am not scared. Italy is more stable than people expect," Letta said during a visit to Greece on Monday.

Both of the major parties may also be reluctant to precipitate an election whose result could be even more chaotic and unpredictable than the February vote and boost support for the populist 5-Star Movement of comedian Beppe Grillo.

BERLUSCONI COUNSELS MODERATION

Berlusconi has for months kept a lid on his hawks, counseling moderation and projecting an image of statesmanship, saying he would not pull the plug on the government with Italy suffering an economic emergency.

However, political sources say this stance was dictated by Berlusconi's lawyers, who wanted to avoid upsetting the supreme court judges. The mercurial magnate's reaction if he is found guilty is uncertain, however.

On Sunday, Berlusconi, 76, broke silence, saying he would insist on going to jail rather than face house arrest or community service for the jail sentence, which has been reduced from four years to one under a 2006 amnesty.

He also told a friendly newspaper, Libero, that while he would not bring down the government, he thought Letta's party would not want to rule with him if he was convicted of a serious crime and banned from public office.

Berlusconi's office later issued a statement that sought to tone down those comments.

His lawyers argue that Berlusconi was not the company official responsible for the tax fraud under which the price paid for television rights was inflated and the money skimmed off into illegal slush funds.

They have filed 50 objections. The Supreme Court rules only on legal procedure and whether the previous appeal court properly justified its sentence.

The court has three choices: convict Berlusconi definitively, acquit him or send the case back to the appeal court because of legal mistakes. It could also postpone a decision, probably until September - a move advocated by moderate politicians who want to avoid a summer crisis.

Even if Berlusconi is found guilty, his ban from public office depends on a vote by his peers in the Senate which could take weeks or months.

Feds deny Boulder?s request to limit cost of divorce from Xcel Energy

Boulder continues to move on the idea of forming its own utility.

The Federal Energy Regulatory Commission has denied the city of Boulder?s request for a declaratory judgment that would limit how much money the city has to pay Xcel Energy Inc. for the utility?s ?stranded costs? if a new, city-owned utility is formed, according to the Daily Camera.

Stranded costs are the value of the power supplies, plus the wires, poles and substations needed to deliver the electricity to the city. Minneapolis-based Xcel (NYSE: XEL) puts the figure at $255 million.

Boulder officials filed a petition with the commissioner in May asking it to set limits on how much the city would have to pay Xcel.

The commission denied the request on Monday, but did say that the total bill may be lower if Boulder continues to buy power from Xcel in order to supply the newly created utility. The commission also said the two sides can return to the issue later when they have more information to present, according to the Camera.

Also Monday, a group formed to oppose a ballot proposal regarding debt limits on the new utility ? a proposal supported by Xcel ? has challenged the signatures on the proposal, according to the Camera.

The city council also is considering its own competing ballot proposal.

?The logical thing is, NASCAR will go back and evaluate how the two days went,? Stewart said after the race. ?We, as a company, will do the same?thing.?

EU, China reach deal to resolve solar panel trade dispute

BRUSSELS/BEIJING ? ?China and the European Union reached a deal on Saturday to defuse a multi-billion euro dispute over Chinese solar panels that threatened a wider trade war.

After six weeks of talks, the EU's trade chief and his Chinese counterpart sealed the deal over the telephone, setting a minimum price for panels from China near spot market prices.

European solar panel manufacturers had accused China of dumping about 21 billion euros ($28 billion) worth of solar panels in Europe last year at below the cost of production, putting European businesses out of business.

Europe planned to impose hefty tariffs from August 6.

But, wary of offending China's leaders and losing business in the world's No. 2 economy, a majority of EU governments - led by Germany - opposed the plan, which led to the compromise deal.

"We found an amicable solution," EU Trade Commissioner Karel De Gucht said.

"I am satisfied with the offer of a price undertaking submitted by China's solar panel exporters," he said, referring to an agreement for a minimum price for China's imports.

Chinese Commerce Ministry Spokesman Shen Danyang welcomed the deal, hailing a "positive and highly constructive outcome".

An EU diplomatic source said the agreed price was 0.56 euro cents per watt, near the spot price for Chinese solar panels in July in Europe, according to solar exchange pvXchange.

That may not satisfy EU solar manufacturers who say the price still constitutes dumping, but China has sold solar panels at as low as 0.38 cents per watt in Europe, according to the European Commission, which handles trade issues for EU states.

Under the terms of the deal, China will also be allowed to meet about half Europe's solar panel demand, if taken at last year's levels. EU consumption was about 15 gigawatts in 2012, and China will be able to provide 7 gigawatts without being subject to tariffs under the deal, the EU source said.

NO MORE SOUR GRAPES?

Chinese solar panel production quadrupled between 2009 and 2011 to more than the world's entire demand as it took advantage of a growing market for renewable energy in the face of concerns about climate change.

But the global financial crisis and ensuing euro zone crisis have forced European governments to withdraw generous subsidies for solar energy. That, along with Chinese imports pushing down prices, have sent many European solar companies into bankruptcy.

German group Conergy filed for insolvency this month.

But those concerns have become secondary to the much larger EU-China trade relationship at stake over the panels dispute.

The EU is China's most important trading partner, while for the EU, China is second only to the United States. Chinese exports of goods to the bloc totaled 290 billion euros last year, with 144 billion euros going the other way.

Responding to the EU's move to impose duties, China launched an anti-dumping inquiry into European wine sales, which may have led to exporters in France, as well as Spain and Italy, being hit with retaliatory duties.

EU and Chinese diplomats now expect that case to be dropped as a goodwill gesture, although officials declined to comment on Saturday.

Kuwait holds parliamentary election

KUWAIT CITY, Kuwait (AP) ? Kuwaiti voters braved searing heat in the middle of the dawn-to-dusk Ramadan fast to cast ballots Saturday in parliamentary elections that leaders in the oil-rich Gulf nation hope can restore some stability after years of escalating confrontations between its Western-backed rulers and an Islamist-led opposition.

The outcome is likely to be strongly in favor of candidates allied with the ruling dynasty as opposition factions have pledged to boycott the voting ? Kuwait's third parliamentary election in 17 months.

But that is no guarantee of calming the political upheavals, which have touched off street clashes and widening crackdowns by authorities on social media. The ruling Al Sabah family ? a close Washington ally ? is facing criticism of overreaching and imposing heavy-handed tactics against a diverse array of foes that includes liberals seeking greater political openness and groups ideologically tied to Egypt's Muslim Brotherhood.

Kuwait's 50-seat parliament has by far the strongest powers of any elected body among the Gulf Arab states. In the past, opposition lawmakers have directly challenged the government of alleged corruption and claims of muzzling dissent. Kuwait's 84-year-old emir controls all key government positions and policies, yet nowhere else in the Gulf can elected lawmakers block initiatives or publicly officials top officials.

The vote, which unusually falls in the middle of the Islamic holy month of Ramadan, was called after a court invalidated the parliament picked in December elections. The court found technical flaws in the election, but let stand new voting rules ordered by Kuwait's ruler that brought one-vote per person.

The former system allowed four votes per person, which could be spread among various candidates. Critics say it encouraged vote buying and pressures by tribal leaders to keep the votes within their clan.

Opposition factions, led by Islamist groups, strongly objected to the change and vowed to boycott the election ? as they did in December. Many Islamists in Kuwait also are dismayed over the country's active support for the military-led leadership in Egypt that took power after toppling Mohammed Morsi and his Muslim Brotherhood-led administration earlier this month. Kuwait has pledged $4 billion to Egypt in loans, grants and fuel.

Other Gulf Arab countries are closely watching the moves by Kuwait's Islamists, considered by the United Arab Emirates and others as part of a wider network seeking to bring down their pro-Western fraternity. Washington, too, is deeply vested in Kuwait's stability as a critical link in the Pentagon's military array against nearby Iran. Kuwait hosts thousands of U.S. soldiers in the largest deployment of American ground forces in the region.

Other groups, such as liberals and online activists, appear willing to join the voting this time. But there is still deep-rooted anger on all sides over Kuwait's social media clampdowns, part of wider Gulf efforts to punish Twitter users and others for posts considered insulting to rulers. Dozens of people in Kuwait have faced charges over online posts since last year.

The rare Ramadan election was held during daylight hours despite temperatures expected to peak near 50 degrees (122 F). There has been no official declaration from Kuwait's religious authorities on whether it was acceptable to break the fasting in the withering heat.

But at least two prominent Islamic scholars were quoted in Kuwaiti newspapers as suggesting that circumstances could open room for eating or drinking during the day, which is permitted under Islamic law for instances such as health or long travel.

Mohammad Tabtabai, a Sunni professor of Islamic law at Kuwait University, said long voting lines in the heat could be considered an "extraordinary" event that would allow breaking the Ramadan fast. A Shiite cleric, Mohammad al-Mohri, that breaking the fast could be allowed for voters forced to travel to distant voting stations.

None of the Kuwaiti parliaments elected from 2003 onward has completed its full four-year term. The first elections in Kuwait were held in 1963, two years after the country's independence.

Death penalty sought against man accused in Texas prosecutors' deaths

(CNN) -- Texas prosecutors said in court Friday they'll seek the death penalty against Eric Williams, a former justice of the peace accused of killing two prosecutors who served in the same county he did.

But what they'll do with the other person charged in the slayings --Williams' wife -- remains up in the air.

Kaufman County, Texas, Assistant District Attorney Mark Hasse was slain in January on his way to work at a courthouse. Two months later, District Attorney Michael McLelland and his wife, Cynthia McLelland, were fatally shot at their home near Forney.

A county grand jury tied all three killings together in April, when they indicted Eric Williams and his wife, Kim, for capital murder.

One big question, though, still loomed: Would prosecutors try to get a death sentence for either or both Williamses, should they be convicted of murder?

That was partially answered Friday, in a brief hearing at the same Kaufman County courthouse where Eric Williams had been justice of the peace.

Special prosecutor Toby Shook told CNN that he and his fellow prosecutor, Bill Wirskye, announced in court that they will go for a death sentence against Eric Williams. But they did not indicate Friday whether or not they'll do the same with Kim Williams.

"We haven't made our final decision," Shook said, adding that there's no deadline to make such a call.

This scenario, as inconclusive as it might be, jives with what Kim Williams' lawyer told CNN on Thursday.

Paul Johnson said then that he expected prosecutors to seek death for Eric Williams, but "was not so sure" about what they would do regarding his client.

County Sheriff David Byrnes has previously said the three killings stemmed from Eric Williams' "past legal problems with the criminal justice system of this county," including a 2012 conviction on burglary and theft charges that led to his removal from office.

His wife, Kim, has confessed to her involvement in the killings and implicated her husband as the trigger man, according to court papers.

In Hasse's death, Kim Williams was the getaway driver; in the McLellands' killings, she was a passenger, Byrnes has said. In both cases, Eric Williams fired the fatal shots, according to the sheriff.

Both Williamses were arrested in April. Eric is also charged with making a terroristic threat, having been accused of using his home computer to threaten police investigating the McLellands' killings, according to a sheriff's affidavit.

He is being held on $23 million bond, according to Kaufman County jail records. His wife -- who is seeking a divorce, her lawyer told CNN on Thursday -- is being held on $10 million bond.

Shook -- who, with Wirskye, was sworn in as a special prosecutor in the murder case two days after the McLellands' deaths -- said that the decision to seek the death penalty against one or both of the accused would not significantly impact their approach.

"We just look forward to preparing the case and trying it in front of the jury," the special prosecutor said.

In your twenties you decide on the final version of you. Sophie is working on it; Frances is stuck in her crazy, clueless, can't-pay-the-rent stage.

It's a tribute to Gerwig's performance, somehow both clumsy and elegant, that she wins us over despite ourselves, that we come to appreciate her aimlessness in a goal-oriented society ...

This is an odd film (creepier than it knows), and even if you feel the atmospheric company of Dunham-ism, with a little of Whit Stillman, Henry Jaglom, and Woody Allen, the core influence on Noah Baumbach's film is fifty years older or more.

Baumbach usually builds his films around difficult protagonists, but Frances is entirely endearing, at once silly and deep, hopeless and promising.

The dialogue and editing are zippy and generally charming, combining with the tart observations of 20-something culture to create a nice frisson.

A black-and-white salute to the French New Wave (the score is borrowed from Georges Delerue, composer of many a Truffaut and Godard film) that manages to be very much of this moment ...

The hilarious, touching Frances Ha is lubricated by the same juice that allowed Jean-Luc Godard's Bande ? Part to slip so smoothly through the streets of Paris.

A film that's well aware of its own hipness, but never too cool to laugh and cry.

Frances Ha might well strike some viewers as ridiculously twee and tiresomely indulgent to its immature heroine. Not me, though. I'm happy to be enchanted.

Gerwig's last jaunt to Europe was in Woody Allen's feeble and disjointed To Rome With Love, and even Allen himself might acknowledge that here she is despatched across the Atlantic in a far more successful cause.

A perky cinematic pick-me-up starring the endearing Greta Gerwig who co-wrote the screenplay with director Noah Baumbach, her boyfriend.

I'm not sure what Noah Baumbach's Frances Ha is about, which is one reason I like it so much.

Frances is only adequate as a dancer but her enthusiasm bridges the gap between aspiration and ability. She deserves an A for effort. The film gets one for attainment.

It's a likable movie, with some nice moments of both comedy and pathos, and beautifully shot, but for me the reverence for its heroine was not completely earned, and the arrowhead was missing: the decisive jab of satire, of insight, of love.

This film may look like one of those annoyingly mannered independent films, with its wacky young cast and arty-farty black and white photography, but it's actually a fresh, smart and very funny comedy.

Noah Baumbach and Greta Gerwig have carved out, with effortless elegance and ease, a cinematic space for a woman to be, unapologetically, herself.

Frances Ha both acknowledges and earns its place in the tradition of the New York bourgeois comedy, encoding the angst of social mores in witty dialogue. Make no mistake: the cinematic slacker has come of age.

An unlikely feelgood crowd-pleaser - Frances Ha is sweet, funny, darling and almost unbearably lovely. And thankfully, everyone enunciates.

Brilliantly directed and beautifully shot, this is an utterly delightful, warm-hearted and very funny comedy with a wonderful script and a terrific central performance from Greta Gerwig.

Despite Gerwig's natural appeal and talent as a performer, Frances' self-absorption and flakiness begin to grate.

When is a film a throwaway sketch that's so good it's frameable? When it's Frances Ha.

Much of the reason why Frances Ha is a far more well-crafted and enjoyable piece of cinema than either Lola Versus or Damels in Distress.

The story becomes chaotic and disjointed, but that's the point: Frances is tumbling towards her 30s with no sense of direction and this is where Gerwig excels, deftly pulling you along on a bumpy ride.

Baumbach and Gerwig have co-written a film about the point when spontaneous, giddy arrested adolescence ceases to be endearing and threatens to be annoying.

Anchored by a charming performance from Greta Gerwig, it's as light and breezy as a walk in Central Park, and just as refreshing.

Pinterest Adds Support For ?Do Not Track? As It Begins To ...

Pinterest announced today that it will add support for Do Not Track, the web browser mechanism that allows users to opt-out of having their personal data and activity collected by websites and third parties. It?s not the first social media company to make this move ? Twitter, for example, announced last year that it would also support the Do Not Track technology.

Do Not Track, for those unfamiliar, is similar in spirit to the Do Not Call registry, in that it allows consumers to state their preferences ? in this case, that they do not want to have their website browsing activity tracked or personal data collected. The technology blocks cookies that collect that personal information, and specifically, the cookies left on users? computers and devices by third parties for the purposes of advertising. However, Do Not Track to work requires cooperation between browser makers, website publishers, and developers to implement.

While the major browser makers have gotten on board, there are still only a small number of websites that support Do Not Track. And until today, Twitter was the only other social network to have made that commitment.

Explains Pinterest in a statement, ?consensus around the technical specs for Do Not Track remain elusive. However, we believe people are making a choice when they turn on Do Not Track. Today, we?re committing to respecting that choice.?

Pinterest users will now be able to turn the feature on or off from their account Settings page at any time, the company says.

Joseph Lorenzo Hall, Senior Staff Technologist at the?Center for Democracy & Technology (CDT), says that Pinterest and Twitter are both supporting Do Not Track in similar ways: by either a browser signal or a preference set by the site itself. His organization is focused on improving consumer choice and privacy options, and hopes that Pinterest?s move will lead to more companies doing the same.

Pinterest?s announcement about its support for Do Not Track comes at a time when the service is interested in better analyzing user activity in order to introduce more personalized features. For example, the company announced today that it?s also adding a new ?Edit Your Home Feed? button on web and mobile that will make it easier to follow or unfollow boards. When you go in to edit your feed, you?ll be shown personalized pin and board suggestions based on things you?ve already been pinning on the service.

So, for example, if you pin a lot of vegetarian recipes, the company explains to us, you?ll then be shown other popular boards that have similar content. In addition, the company will also soon introduce recommendations for boards based on the sites you visit with the ?Pin It? button ? something that?s similar to what other companies, including Twitter, do to personalize their own experiences.

By adding support for Do Not Track just as the company begins to dig further into user data, Pinterest is at least giving its users a choice in whether or not their data is collected, and it?s one of only a few sites to really do so.

However, Do Not Track is a technology and proposal that?s currently being debated by the industry, with those companies dependent on ad revenue, like Yahoo, TechCrunch parent AOL, and others, fighting with browser makers on how the push toward a Do Not Track standard should proceed. As the CDT explains it, a lot of the debate centers around whether DNT should mean ?do not collect? data, ?do not target? users, or whether it should mean ?practice good data hygiene.? ?(In Pinterest?s case, it?s the former, which is what DNT means today).

The interesting thing about Pinterest?s implementation of DNT is that it will eventually change what the end-user experience is for those who do or do not enable the setting. For those who permit Pinterest to personalize the site, they?ll have an improved way to discover new content, pinners, pins, and boards they may like. But for those who opt out of tracking, personalized boards will not be shown, which means those users? Pinterest experiences will remain basically unchanged.

Given that Pinterest?s discovery mechanisms today include a basic category list, search box, and ?find friends? functionality, regular users have likely been looking forward to the introduction of new features that would allow them to better explore more of Pinterest.

But now, those users will have to make a choice about whether or not their privacy ? or their personalizations ? are the most important thing to them.

Pinterest is a social networking site with a visually-pleasing ?virtual pinboard? interface. Users collect photos and link to products they love, creating their own pinboards and following the pinboards of other people whom they find interesting. The site has experienced rapid growth in recent months.

South Florida ranks near the bottom in a new listing of real estate recoveries across the country.

Homes.com calculated metropolitan areas? rebound in home prices when compared to past peaks, before the housing bubble popped and values crashed. Leading the way: Texas, with six of the 10 top spots. San Antonio holds the No. 1 ranking in the homes.com list, beating its pre-bust value peak by about 120 percent.

South Florida, including Palm Beach, finished 11th from the bottom of the list of 100 metropolitan areas on the homes.com study. According to the site?s index, South Florida homes have covered about 14 percent of their value since hitting bottom.

Obama, lawmakers square off over NSA authority

WASHINGTON (AP) ? The Obama administration squared off with skeptical lawmakers Tuesday over efforts to terminate the government's authority to collect phone records of millions of Americans, a proposition that exposed sharp divisions among members of Congress.

With a vote nearing on amendments to a $598.3 million bill to fund the military, the White House raised the alarm over a move to end the National Security Agency's authority under the USA Patriot Act, preventing the secretive surveillance agency from collecting records unless an individual is under investigation.

And in an unusual, last-minute lobbying move, Gen. Keith Alexander, head of the NSA, traveled to Capitol Hill to urge lawmakers to oppose the amendment in separate, closed-door sessions with Republicans and Democrats.

"We oppose the current effort in the House to hastily dismantle one of our Intelligence Community's counterterrorism tools," White House press secretary Jay Carney said in a late-night statement. "This blunt approach is not the product of an informed, open or deliberative process."

Carney said President Barack Obama is still open to addressing privacy concerns in the wake of documents leaked last month by former NSA systems analyst Edward Snowden that revealed that the vast nature of the agency's phone and Internet surveillance. But he said Obama wants an approach that properly weighs what intelligence tools best keep America safe.

In another sign the White House was treating the measure with serious concern, its rebuke came directly from the press secretary, rather than the more routine notices from Obama's budget office the White House normally uses to weigh in on pending legislation.

The proposal offered by Rep. Justin Amash, R-Mich., dovetails with another amendment to the defense bill to cut off funds for the NSA. The House is likely to vote on the amendments Wednesday.

The fierce debate over privacy and national security has divided Congress, transcending the partisan lines that typically characterize legislative fights ? especially in the House.

Tea party conservatives and liberal Democrats have backs the amendments, joined by libertarians like Amash who have expressed serious concerns about the government's surveillance. But national security hawks have strongly defended the programs, as have House leaders such as Speaker John Boehner, R-Ohio, and House Intelligence Committee Chairman Mike Rogers, R-Mich.

In the Democratic-controlled Senate, the leaders of the Senate Intelligence Committee have opposed the amendments, arguing that the surveillance programs have helped disrupt numerous attempted terrorist attacks.

"Any amendments to defund the program on appropriations bills would be unwise," Sens. Dianne Feinstein, D-Calif., chairwoman of the panel, and Saxby Chambliss of Georgia, its top Republican, said in a statement Tuesday.

Despite its insistence the NSA's authority should be preserved, the White House said Obama welcomes discussions with Americans and Congress about the proper balance between national security and privacy. But civil liberties advocates have said that sentiment is insufficient and hypocritical, pointing out that such a discussion would have been impossible if the programs hadn't been exposed by Snowden, who now faces felony charges.

Alexander made the Tuesday trip to ask lawmakers to reject the amendments at the request of the heads of the House Intelligence Committee, Rogers and Rep. C.A. Dutch Ruppersberger, D-Md. The two also warned in a statement that ending the program's authority would put the nation at risk of another terrorist attack.

Separately, seven Republican committee chairmen sent a letter to colleagues calling on them to oppose the Amash amendment. Meanwhile, House Republican leaders struggled to limit amendments on the overall bill, concerned about hampering national security and anti-terrorism efforts.

The defense spending bill would provide the Pentagon with $512.5 billion for weapons, personnel, aircraft and ships plus $85.8 billion for the war in Afghanistan for the fiscal year beginning Oct. 1.

The bill is $5.1 billion below current spending and has drawn a veto threat from the White House, which argues that it would force the administration to cut education, health research and other domestic programs to boost spending for the Pentagon.

In a leap of faith, the bill assumes that Congress and the administration will resolve the automatic, across-the-board spending cuts that have forced the Pentagon to furlough workers and cut back on training. The bill projects spending in the next fiscal year at $28.1 billion above the so-called sequester level.

Study: Organ donor with rabies had 2 raccoon bites

WASHINGTON (AP) ? An Air Force recruit whose organs were donated to four patients including a kidney recipient who died of rabies had at least two untreated raccoon bites several months before he became sick, and tests confirm his rabies-infected kidney caused the recipient's disease, according to a medical journal report.

Doctors initially attributed the donor's death to other causes. But during an investigation prompted by the kidney recipient's death in February, lab testing found evidence of rabies in the donor's brain tissue and also detected encephalitis, a brain inflammation that can be caused by rabies.

The virus was consistent with raccoon rabies and was nearly identical to a virus found in the transplanted kidney and other tissue from the recipient, an Army veteran from Maryland, said the report, compiled by researchers from the federal Centers for Disease Control and Prevention and others and published Tuesday in the Journal of the American Medical Association.

Investigators don't know if organs given to three other patients ? the North Carolina donor's heart, liver and second kidney_were infected with the rabies virus, but all three were considered at risk. Their recipients received anti-rabies treatment "and to date remain well," said CDC researcher Dr. Neil Vora, the lead author.

While the case is rare, it underscores the need to improve screening for would-be organ donors with suspected encephalitis, the report's authors say. They say a uniform donor questionnaire could help better identify risk factors for the virus and that rabies should be considered in donors with unexplained encephalitis.

The United Network for Organ Sharing issued guidance last year to help organ procurement organizations screen for encephalitis and other central nervous system infections in potential donors. It urged caution in accepting organs from donors with an untreated central nervous system infection.

The researchers want to improve awareness that rabies can be the cause of encephalitis, said co-author Dr. Sridhar Basavaraju, another CDC researcher. But he added, "We wouldn't want to mandate any screening that would potentially exclude transplantable organs."

The study is based on a review of laboratory tests and medical records, and interviews with relatives of the organ donor and recipient. It provides the most detailed account of the chain of events that led to the two deaths and the investigation that followed, which prompted health authorities to recommend vaccines for dozens of people who were in contact with the donor or recipients.

The case attracted public attention because of the rare circumstances, including the long time between infection and death of the transplant recipient ? about a year and a half.

It was just the third documented transmission of rabies through a solid organ transplant, the report says.

Also, there are only roughly two human rabies deaths in the United States each year, and all but two domestic cases between 2000 and 2010 were linked to bats, according to the report. The authors say raccoons pose an under-recognized risk for infection and their spread into urban areas raises concern.

The patient who received the North Carolina donor's kidney at the Walter Reed National Military Medical Center in Bethesda, Md. in September 2011 has not been publicly identified.

The donor was 20-year-old William Edward Small, an avid outdoorsman from North Carolina who got sick after a fishing trip in Florida, where he was undergoing Air Force training.

Small's initial symptoms included nausea, vomiting and fever ? which could indicate rabies but also other less serious conditions that are much more common. Doctors thought Small had eaten tainted fish.

Questioned during the organ procurement process, relatives said they didn't know of any recent risk of rabies exposure, and doctors did not test him.

Investigators say they learned during subsequent interviews that Small trapped raccoons for use as bait during hunting-dog training exercises, and had been bitten at least twice by the animals, 18 months and seven months before developing symptoms. He was not treated for those bites.

"If you don't ask specific questions, you don't get specific answers," said Dr. Michael Green, chairman of an advisory committee on disease transmission for the United Network for Organ Sharing.

"At the time these questions are being asked initially, families are often traumatized, in shock," Green said. "They're losing a loved one. They may not be thinking normally or straight or remember all those details."

Gas prices increase by a nickel in W.Va.

CHARLESTON, W.Va. (AP) -- Gasoline prices have increased an average of about a nickel per gallon during the past week in West Virginia.

AAA East Central says the price for a gallon of regular unleaded is nearly $3.68 per gallon. That's about a penny higher than the national average and 17 cents higher than a year ago in the state.

Prices range from $3.58 in Parkersburg to $3.82 in Martinsburg.

In a virtually uninhabitable section of South Australia, a discovery has been made which could rock the world.? Some are calling it the biggest discovery of oil in 50 years.? Earlier this year, a company called Linc Energy announced that tests had revealed that there was a minimum of 3.5 billion barrels of oil equivalent sitting under more than 65,000 square kilometres of land that it owns in the Arckaringa Basin.? But that is the minimum number.? It has been projected that there could ultimately be?up to 233 billion barrels of recoverable oil?in the area.? If that turns out to be accurate, the oil sitting under that land is worth approximately?20 trillion dollars, and it would be roughly equivalent to the total amount of oil sitting under the sands of Saudi Arabia.? In essence, it would be a massive game changer.

If the 233 billion barrel figure is accurate (and some have even suggested that the true number could actually be 400 billion barrels), that would make it nearly 10 times larger than the Bakken formation, 17 times larger than the Marcellus discovery and 80 times larger than the Eagle Ford deposit down in Texas.

It would also mean that Australia now has more ?black gold? than the nations of Iran, Iraq, Canada and Venezuela.

The closest town to this oil discovery,?Coober Pedy, is in the process of being totally transformed.? It normally only has about 1,700 inhabitants, but news of this discovery has drawn in 20,000 additional people already and real estate prices in the town are absolutely skyrocketing.

So does all of this mean that gas prices will go down soon?

Well, unfortunately that is not likely to be the case.

First of all, the oil in this formation in Australia is going to be quite expensive to extract.? It has been estimated that it is going to cost?up to 300 million dollars?just to get this site ready for production.

In addition, many of our politicians are absolutely determined to greatly punish the use of oil because they believe that it is the primary cause of global warming.? So they continue to raise taxes on gasoline consumption.

Today, motorists in the United States pay an average of?49.5 cents?of taxes per gallon of gasoline, and in the state of California motorists pay an average of?71.9 cents?of taxes per gallon of gasoline.

Hopefully the price of gasoline will come down a bit over the next few years, but even if it does I would not expect it to come down too much.

But what we can be sure of is that the world is not going to run out of oil any time soon.? Those that have been predicting that we are are on the verge of an ?energy doomsday? can take a rest for a while.

Sometimes it is funny to look back and remember some of the ridiculous things that our politicians were saying about oil in the old days.? For example, U.S. President Jimmy Carter made the following statement back in 1977?.

?Unless profound changes are made to lower oil consumption, we now believe that early in the 1980s the world will be demanding more oil than it can produce?.

That prediction didn?t exactly work out for him did it?

It is time that the American people were told the truth about our energy situation, and the truth is that we have plenty of energy resources.? The following stats have been updated from one of my?previous articles?

#1?Back in 1995, the U.S. Geological Survey told the American people that the Bakken Shale formation in western North Dakota and eastern Montana only held 151 million barrels of oil.? Today, government officials are admitting that it holds?7.4 billion barrels of recoverable oil, and some analysts believe that the actual number could be closer to?24 billion?barrels of oil.

#2?It is estimated that there are?19 billion?barrels of recoverable oil in the tar sands of Utah.

#3?It is estimated that there are?86 billion?barrels of?recoverable oil in the Outer Continental Shelf.

#4?It is believed that there are?800 billion?barrels of?recoverable oil in the Green River formation in Wyoming.

#6?According to the Institute of Energy Research, the United States has an?88 year supply?of natural gas.

#7?According to the Institute of Energy Research, the United States has a?169 year supply?of oil.

#8?According to the Institute of Energy Research, the United States has a?465 year supply?of coal.

#9?Goldman Sachs is predicting that the United States will be the number one oil producing country in the world?by the year 2017.

So the bottom line is that we have plenty of energy resources.? We do not need to be importing oil from OPEC or anyone else.

But just because we are not going to run out of oil, natural gas or coal any time soon does not mean that we should not be developing alternative energy resources.? We should definitely be seeking ways to produce energy more cheaply, more cleanly and more efficiently.

If America does not end up leading the world in developing new forms of energy, we should be ashamed of ourselves.? And right now, the Chinese appear?to be way ahead of us?as far as thorium energy is concerned, and Italian scientists appear to be ahead of our own scientists?in developing ?cold fusion? technology.

So yes, let?s be glad that we are not going to be facing a crippling energy crisis in this generation, but let?s also not be complacent.? There are lots of new technologies out there just waiting to be developed, and the rewards are going to go to those that are able to develop them first.
